Section 1. Title of the Act
This Act shall be known as the "National Flag Protection Act of 2024."
Section 2. Declaration of Policy
It is hereby declared the policy of the State to recognize the National Flag as a sacred symbol of national unity, sovereignty, and pride. The State shall ensure that the National Flag is accorded due respect and shall protect it from any form of desecration.
Section 3. Definition of Terms
For the purposes of this Act, the following terms shall have the following meanings:
(a) National Flag – refers to the official flag of the Republic, representing the country's sovereignty, independence, and unity.
(b) Desecration – refers to any act that defiles, defaces, tramples upon, or otherwise dishonors or shows disrespect to the National Flag.
(c) Public Display – refers to the exhibition of the National Flag in any public space, including but not limited to government buildings, schools, public events, and any other venue where the public is present.
Section 4. Prohibited Acts
The following acts are prohibited under this Act:
(a) Mutilating, defacing, defiling, burning, or trampling upon the National Flag in any manner.
(b) Using the National Flag for any commercial purpose, including advertisements, trademarks, or as a part of any merchandise.
(c) Wearing the National Flag as clothing or any other wearable item.
(d) Displaying the National Flag in a manner that would degrade, insult, or show disrespect to its significance as a national symbol.
(e) Using the National Flag in any public event or gathering that promotes violence, hatred, or any form of illegal activity.
Section 5. Mandatory Display and Respect for the National Flag
(a) The National Flag shall be displayed in all government offices, educational institutions, and other public spaces as mandated by existing laws and regulations.
(b) During any public event where the National Flag is displayed, all persons present shall render the proper salute or place their right hand over their chest as a sign of respect.
Section 6. Penalties
Any person found guilty of violating any provision of this Act shall be subject to the following penalties:
(a) A fine not not less than 100,000 Dollars or imprisonment for a period not less than 5 years, or both, at the discretion of the court.
(b) If the violation is committed by a corporation, partnership, or other juridical entity, the penalty shall be imposed upon the responsible officers thereof.
(c) Foreign nationals found guilty of violating this Act shall be subject to immediate deportation after serving any sentence imposed.
Section 7. Implementation and Regulation
The Ministry of Security shall be responsible for the implementation of this Act and shall issue the necessary rules and regulations to ensure its effective enforcement.
Section 8. Repealing Clause
All laws, decrees, orders, rules, and regulations, or parts thereof, inconsistent with the provisions of this Act are hereby repealed or modified accordingly.
Section 9. Separability Clause
If any provision of this Act is declared invalid or unconstitutional, the remaining provisions shall remain in full force and effect.
Section 10. Effectivity
This Act shall take effect immediately after the approval of Supreme Chancellor.
