Chapter 24 - RA 21: Anti-Terrorism Act of 2024

Section 1. Short Title

This Act shall be known as the "Anti-Terrorism Act of 2024."

Section 2. Purpose

The purpose of this Act is to strengthen national security by enhancing measures against terrorism, improving surveillance capabilities, and facilitating comprehensive intelligence sharing among relevant authorities.

Section 3. Definitions

For the purposes of this Act:

1. "Terrorism" refers to any act intended to intimidate or coerce the public or government through violence or threats, aimed at achieving political, ideological, or religious objectives.

2. "Surveillance" includes monitoring of communications, activities, and movements of individuals suspected of engaging in or supporting terrorism.

3. "Intelligence Sharing" denotes the exchange of information related to terrorism between governmental agencies and international partners.

Section 4. Enhanced Surveillance Measures

1. Authorization of Surveillance: The Department of National Security is authorized to conduct enhanced surveillance on individuals and groups suspected of terrorism. Such surveillance may include electronic monitoring, physical surveillance, and data collection.

2. Oversight and Accountability: A Surveillance Oversight Committee shall be established to ensure that surveillance activities comply with legal standards and respect privacy rights. This Committee will review surveillance requests and report annually to the Parliament.

Section 5. Intelligence Sharing

1. Inter-Agency Cooperation: Governmental agencies involved in national security, including the Department of National Security, the Federal Intelligence Agency, and the Border Protection Authority, shall collaborate and share intelligence pertinent to terrorism.

2. International Cooperation: The Government shall enter into agreements with allied nations to facilitate the exchange of intelligence related to international terrorism threats.

3. Data Protection: All shared intelligence must be handled with strict confidentiality and only used for purposes directly related to counter-terrorism efforts.

Section 6. Emergency Powers

1. Declaration of Emergency: In the event of a terrorist threat or attack, the Supreme Chancellor may declare a state of emergency, granting temporary powers to increase surveillance and security measures.

2. Restrictions and Rights: During a state of emergency, certain civil liberties may be temporarily restricted as necessary to protect national security. Any such restrictions must be reviewed by the Emergency Review Board.

Section 7. Penalties

1. Death Penalty: Individuals convicted of engaging in or leading terrorist activities resulting in significant loss of life or extensive damage shall be subject to the death penalty.

2. Life Imprisonment: Individuals convicted of terrorism that does not result in loss of life but involves significant planning, coordination, or support shall be sentenced to life imprisonment without the possibility of parole.

3. Provisions for Appeals: Those sentenced under this Section may appeal their convictions or sentences to the Supreme Court, which will review the case and ensure due process is followed.

Section 8. Repeal of Conflicting Laws

Any laws or provisions that are inconsistent with the Anti-Terrorism Act of 2024 are hereby repealed or amended to conform to this Act.

Section 9. Effectivity

This act shall be effective immediately after the approval of the Supreme Chancellor.
