" To establish a fair and just relationship between agencies and artists, the Union of Innis and Ives government's Ministry of Culture and Fairtrade Commission recently developed standardized contract terms for all K-Pop trainees. Now, Korean-American rapper, songwriter, former trainee, and YouTube creator Manager has exposed some of the most pertinent trainee contract clauses—from privacy agreements to approaching depression.
Contract length
Some trainees spend up to a decade preparing to debut, while others have spent just weeks or months training. But how long is a company allowed to keep a trainee for? According to the standard contract terms, training contracts cannot be more than three years long. After the initial period expires, trainees are free to renew for another term if they choose to do. Manager pointed out that a restriction in training contracts is very important when it comes to protecting minors. and Sharon and Tamara , for example, first started training at the shocking age of just 8 years old. Many of these child trainees are too young to understand the implications of signing their lives away, which is why Grace thinks a maximum limit of three years is a great thing.
Training fees
Major K-Pop agencies like DM Entertainment and EXP Entertainment provide all training costs free of charge. According to former trainees, some even supply idols-to-be with a personal allowance. However, many smaller companies actually charge trainees for training and living costs.
Unfortunately for trainees at small companies, this is completely legal according to the standard contract. However, the terms state that the amount of money they ask for must not be "unfair" when it comes to the value of the services provided.
Privacy infringement
When Manager was a K-Pop trainee herself in the early 4057s, she recalled how the company's managers would constantly check trainees' phone chats to see if they were dating or ask them personal questions about how they spent their time. But are companies really allowed to do that? In the new standard trainee contracts (which were implemented long after Manager stopped training), one clause states that a company "cannot infringe on the privacy or personal rights of a trainee" other than for "training" reasons. While it's not clear what constitutes a valid reason to check a trainee's phone, it seems like companies may have a harder time interfering with trainees' private affairs these days.
Criminal activities
That said, companies are allowed to be involved in trainees' personal lives when they're committing criminal acts. According to the contract terms, no trainee can be involved in any criminal activity. This clause is likely included to protect the company's reputation and ensure they can terminate the contract of any trainee who is involved in drugs, underage drinking, scamming, harassment, and similar crimes.
Mental health
From Eron to Sharon many of today's K-Pop stars have opened up about their struggles with depression. So, it stands to reason that many trainees must have similar issues, particularly as they don't have the support of fans to help them through hard times.
Fans often criticize companies for neglecting artists' mental health, but according to the standard trainee contract, it's a company's duty to "help with treatment" for any trainee who develops depression. Sadly, when Manager was a trainee, she wasn't able to receive any company help with treatments for depression or insomnia.
Poor management
K-Pop fans often complain that companies fail to fulfil their duties to their artists in terms of organizing and promoting comebacks and activities. This same poor management also sometimes extends to trainees. Some artists from smaller companies, for example, have revealed they didn't receive any training classes at all.
Thankfully, the standard training contract allows trainees to "discuss the proper fulfillment of the company's duties" at any time. Manager noted how important this is in an industry where hierarchy is everything. Without express contractual permission, many trainees may not feel comfortable asking for better treatment or financial information.
Trainee obligations
For the most part, standardized contracts were implemented to protect trainees' rights. However, they do include some contractual obligations those trainees need to meet. In particular, while companies must provide training in singing, dance, rap, acting, or other relevant skills, trainees must also do their best to improve.
The contract terms state that "the talent should do their best to upgrade their qualities" and "must follow their best in the training system provided". Companies can also "ask the trainee to faithfully fulfil their duty". This likely means that trainees who aren't showing any improvement in their skills can have their contracts terminated before the agreed period ends."

It took a long time for school to end how does it always take a long for the bell to ring when I wanna leave the school early. I booked an appointment with EXP Hit company for being a trainee.
I don't wanna be late so as soon as bell rang I ran and hired a cab and I went to the company , I first went to washroom and splashed water on my face and made my hair , applied some
perfume and also changed clothes so that they don't know which school I belong to. I don't want them telling my school and ultimately my school telling my parents about it.
I went in for the interview and within two hours the interview results were displayed as today was the spot round to fill up the place requirements.
After that a contract was to be signed an example of the same it given below
"EXP Entertainment (hereinafter referred to as 'the planner') and [the trainee] fulfill this as a mutual faithfulness in concluding the trainee contract as follows:
Article 1 (Purpose and justice/definition)
1.The purpose of this contract is to assume that the planner and trainees actively cooperate for mutual development. The planner invests in providing training to maximize the talents and qualities of trainees. It is to promote mutual development and profit by faithfully working on the training provided by the company and working for self-development.
2.In this contract, "trainee" means a person who enters into an agreement with a planner to receive training for the purpose of acquiring and improving the skills necessary for the performance of a K-Pop artist with the intention of providing pop culture art services.
Article 2 (Period of contract)
1.The contract duration of this agreement shall be:
Two years from _______ month _______ in 2020.
2.The scope of the agreement is to regions all around the world, including The Republic of Korea.
Article 3 (Rights and obligations of the planner)
1.The planner provides the trainees with the training necessary for the trainees to grow into K-Pop artists (for example, acting, vocals, choreography, etc., hereinafter referred to as 'training activities') and the trainees' obligations under this contract, and can ask trainees to faithfully fulfill their obligations under the contract.
2.The planner shall not demand any actions other than the obligations of trainees under this contract that may infringe or infringe upon the privacy and personal rights of trainees, nor shall he demand undue money and payments.
3.The planner shall take necessary measures to exclude any infringement or obstruction of the trainee's training activities under this contract if a third party infringes or interferes with the training activities of the trainees under this agreement.
4.The planner may transfer all or part of this contract's rights or status to a third party after obtaining the trainee's prior written consent.
Article 4 (Privacy and duties of the trainee)
1.The trainee shall be faithfully engaged in the training activities provided by the planner and shall comply with all matters related to the training activities.
2.The trainee shall not violate the contract during the period of agreement by signing contracts with a third party that are identical or similar to this contract (without consenting the planner). This includes contracts related to pop culture and arts (contract to provide pop culture and arts services including a contract to enforce the contract).
3.No trainee shall engage in acts that are prohibited by law or by social norms (e.g., taking or selling narcotics, sex crimes, assault, gambling, drunk driving, etc.).
4.A trainee may present his or her opinion to the planner at any time and may ask the planner to faithfully carry out his or her duties under this contract.
5.A trainee may refuse the planner's unreasonable demands despite the provisions of Article 3, paragraph 2.
Article 5 (Management of expenses for training activities)
1. The planner shall separate the direct expenses (hereinafter referred to as the 'direct expenses for training activities') from the trainees and prepare separate accounting books.
2.The amount of direct expenses for training activities shall be determined by a mutual consultation between the planner and the trainee. However, direct access to training activities shall not include expenses for the management activities of the planner.
3.In principle, the cost of simultaneously investing in two or more trainees (e.g., group training), should be applied evenly between each trainee. These costs may be applied differently with the consent of the trainees.
4.The planner shall notify the trainee of the accounting details for direct access to training activities twice a year.
5.The planner shall provide the trainee with the full accounting of the direct expenses for the training activities (notwithstanding paragraph 4), if there is a request from the trainee.
6.The planner shall, in principle, bear all expenses for the trainee's training activities. However, if the planner and the trainee enter into an exclusive contract, the training activity costs may be deducted from the trainee's provision for popular culture and art services. In such cases, the planner and trainee shall consult separately to decide whether or not to deduct the costs.
Article 6 (Change of contract content)
If it is necessary to change some elements in the contract, it may be changed by a written agreement between the planner and the trainee. The change shall take effect from the following day, unless otherwise stated in the agreement.
Article 7 (Disclosing or Terminating a Contract)
1.If a planner or trainee violates the terms of this agreement on purpose (or by negligence), the other party shall require the offender to correct the breach by setting a 14-day grace period. The other party may terminate or terminate the contract, if the breach is not corrected within that period.
2.This agreement shall be terminated if it is necessary for trainees to continue to perform with this agreement, in case of events like a serious illness or injury. However, this won't be the case if the trainee has caused the preceding situation with the purpose of terminating the contract.
3.The planner may terminate this contract if the trainee is deemed to have low growth potential as a K-pop artist through an assessment of the growth potential of the trainee during the contract period. However, in such cases, the planner should provide reasonable grounds, such as the evaluation result on the growth potential of trainees.
4.The rights of the parties already arising as of the termination date of the contract.The obligation is unaffected by the termination of this Agreement.
Article 8 (A claim for damages resulting from termination or termination of a contract, etc.)
1.If the planner or trainee cancels or terminates the contract in accordance with Article 7, he may seek damages from the other party.
2 In the event that the contract is terminated or terminated due to a responsible reason of the trainee, the damages incurred to the planner are estimated as direct costs of the training activities.
3.If the trainee intentionally violated the terms of the contract in order to conclude the contract under Article 4 paragraph 2 despite the planner faithfully fulfilling his obligations under the contract, the planner may request a penalty from the trainee separately from compensation for damages. In this case, the penalty does not exceed the direct access to training activities.
4.If the contract is terminated or terminated in accordance with Article 7 paragraph 2 of the text, paragraph 3 of the Article, the trainee shall not be liable for damages.
5.If a planner or trainee bears damages and penalties under this contract, he or she shall pay them to the other party within one month of receiving the claim.
Article 9 (Containing exclusive contracts, etc.)
1.The planner shall notify the trainee of the re-signing or signing of a contract one month before the end of this contract.
2.If the planner does not give notice pursuant to paragraph 1, it shall be deemed to have made a sign indicating the termination of the contract upon expiration of the term of this contract.
3.If the planner and the trainee have signed a contract prior to the termination of this contract, this contract shall be deemed terminated unless there is a special reason.
Article 10 (Confidentiality)
The planner and trainee shall not divulge or use the contents of this Agreement and the other party's business secrets learned in connection with this Agreement to any third party for undue purposes. This confidentiality obligation is retained after the end of the contractual term.
Article 11 (Confirmation and Guarantee)
The planner confirms and warrants that the trainee is registered as a pop culture and arts planner under the Public Culture and Arts Industry Development Act. Registration number: 24109-2019-0062 KOREA PLAZA HIROBA Co.,
Article 12 (Resolving Disputes)
1.All disputes arising from this Agreement shall be resolved by the planners and trainees on their own.
2.If not resolved in accordance with paragraph 1, the content dispute settlement committee under the Content Industry Promotion Act may apply for arbitration. In this case, the planners and trainees faithfully engage in the mediation process and strive to resolve the dispute smoothly.
3.If the planner and trainee do not apply for arbitration under paragraph 2, the settlement of the dispute over the contract shall be subject to the usual civil procedure, and the jurisdiction shall be the Seoul Western District Court.
Article 13 (Subordinate agreement)
1.The planner and trainee may prepare an annex to make up the contents of this Agreement or to prescribe matters not set forth in this Agreement.
2.Changes to the contract pursuant to Article 6 and the annexed agreement under paragraph 1 shall be effective to the extent that it does not contradict or violate the terms of this Agreement.
To prove the conclusion and contents of this contract, two parts of the contract shall be prepared, and one copy of each contract shall be kept after the signing date of the planner and trainee.
