The man responsible for the crash didn't have the blood of innocents on him, but he would have if Eleanor wasn't on that flight.
If Elena wasn't on the flight, Eric wouldn't have told Rudy, and Rudy wouldn't have remembered the tragic incident.
Rudy was conflicted about whether he should punish the man or not. Even if he let him go, he was going to be prosecuted in court. Rudy knew what was coming for the man, and he was satisfied with whatever punishment and the allegation that man was going to get.
