Chapter 8 - The Trial

"I here by ask Prosecutor Dyer to take the stand." The judge announced.

"Thank you, Judge Turner." Prosecutor Dyer began his opening statement. "The murder of Don Parker happened not too long ago. The time of his death was on Tuesday, September 19, 2017. I here by announce Ms. Anastasie Berger as the suspect of this crime. Let us now hear the defendant's plea."

I then was standing in front of the whole court ready to defend myself. "I did not murder Don Parker. I didn't even know who the man was. I was out late at night, yes, but I was on my home. That was when I saw the murder of the poor man. I hid when the murderers were killing him. I didn't know what else to do at them moment. I was scared. If I were a man who knew self defense, that would have been different. However, I'm a woman and compared to 4 other strong men, I'm weak. I did not kill Mr. Parker."

"Now, we will hear the prosecutor's preliminary hearing (evidence presented by the prosecutor to prove the defendant guilty)." The judge nodded his head.

"Yes, Judge Turner. Looking at the time of the murder and Ms. Berger being at the same place at the same time seems all to fishy." Prosecutor Dyer took out the first evidence. "Take a look at this photo for a moment. In this photo, it shows Ms. Berger touching Mr. Parker. Doesn't this seem suspicious to you? For a person who was just walking home, why would Ms. Berger have anything to do with a dead body?"

"Yes, why that does seem suspicious." The judge nodded his head in agreement.

"I here by call upon the witness, who witnessed Ms. Berger in the alley, to come to up to the stand." Prosecutor Dyer announced.

A woman dressed in black with a black hat walked up to the witnesses stand.

"This here is Ms. Gina Thornton. She is the witness of the murder. Isn't that correct, Ms. Thornton?"

"Yes that is correct." Ms. Thornton wiped a tear off of her cheek.

"Please give your testimony, Ms. Thornton."

"Of course." Ms. Thornton then slammed the table podium in front of her. "Listen loud and clear, everyone. This woman here killed Mr. Don Parker! I am ashamed of her! I, a close friend of Mr. Parker and his wife, am distraught! Yes, I saw her murder Mr. Parker. And she killed him with a pistol!"

"A pistol?" The judge questioned.

"Yes a pistol. I saw it with my own eyes. I saw her shoot the the poor man! When I saw her shoot the man, I quickly took a picture and ran to the police! That is all."

"Alright. Defense, ready with your cross-examination." The judge announced.

"Yes, sir." Mr. Wilson then walked around the room. "Ms. Thornton, what time did you see the murder happen?"

"Exactly 12:57 am."

"I understand. Now when you mentioned you saw Ms. Berger killing Mr. Parker, how did you notice she was in the alley? Wasn't it dark around that time of night?"

"I heard two gunshots, of course. That's how I was able to spot her in the alley."

Wait...that wasn't right. The gun was silent. she's couldn't have possibly heard the gun shot. I hate that I can't say anything. I hate it.

"I understand. Do we have the gun with us here today?" Mr. Wilson asked.

"Yes. We have the evidence right here." Prosecutor Dyer brought out the pistol. "This was the gun with its bullets founded in Mr. Parker's body."

"I understand." Mr. Wilson nodded his head. "So this was the gun."

How did they find the weapon? No, not the actual weapon. A "fake" weapon? How did they make this mistake?

"Are you sure those are the right bullets that were in Mr. Parker? Or is this forged evidence?" Mr. Wilson asked.

"Of course not. This is why I'm going to ask upon the next witness. Thank you, Ms. Thornton."

After Ms. Thornton left the stand, the next witness came.

"Welcome, Mr. Kerry Snyder." Prosecutor Dyer introduced the witness.

"Yes, you may state your next testimony, Mr. Snyder." The judge agreed.

"Yes." Mr. Snyder nodded his head. "When I was at home around 12:40-ish, I was having a cold night sleep. I knew something was up. I looked out my window, because I heard talking, but I couldn't see due to the darkness."

"Did you hear a gun shot, Mr. Snyder?"

Mr. Snyder then looked at me. He then gave me a smirk. "No, I didn't."

The jury and everyone in the court room became quiet. He just contradicted what Ms. Thornton said. What is going on?
